This Agreement governs your access and use of products, content, and services offered by Starfish Technology Limited (4171 VICTORIA, Las Vegas, NV 89121, USA), including game software, related updates and features, and all online and mobile services, platforms, websites, and live events associated with Starfish Technology Limited (collectively referred to as "Starfish Services").


If you do not agree to these terms, please refrain from installing or using our games or services.


BY USING STARFISH SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE STARFISH SERVICES.


1. Account


To play our game, you are required to have an Account. Creating an Account necessitates having a valid email address and supplying truthful and accurate information. Additionally, you must be eligible to use the specific Starfish Service you are registering for and be a resident of a country where the use of Starfish Services is permitted.


2. Availability of Starfish Services and Updates


Our games and services may not always be available on all devices, and we reserve the right to make updates or changes that could affect your gameplay or progress.


We do not guarantee continuous availability of any Starfish Service, Content, or Entitlements in all locations or at all times. We may discontinue offering specific Starfish Services, Content, or Entitlements at our discretion. Furthermore, we cannot guarantee that Starfish Services will be accessible on all devices, through specific internet or connection providers, or in every geographic location.


Periodically, Starfish may update, change, or modify a Starfish Service, Content, or Entitlements without prior notice. These updates or modifications may be necessary to maintain the functionality and integrity of our Services.


Starfish may adjust certain parameters within games to ensure fair gameplay and usage of our Services. These updates or "resets" may impact your progress within the game world and affect characters, games, groups, or other Entitlements associated with your account.


Additionally, we reserve the right to take actions on your Account and Entitlements without prior notice if necessary to protect you or Starfish. This includes preventing unauthorized access, resetting account passwords, suspending account access, deleting data, or removing accounts from our Services. Your access to Starfish Services may also be restricted in response to actual or suspected violations of our Rules of Conduct.


Please be aware that while we strive to provide a consistent and enjoyable experience, circumstances beyond our control may necessitate changes or adjustments to our games and services.


3. Rules of Conduct


We want all players to have a positive and enjoyable experience playing our games. To ensure this, we expect you to respect Starfish, our employees, representatives, and your fellow players. This includes adhering to certain guidelines such as obeying the law, refraining from cheating, avoiding offensive behavior, abstaining from hacking our software, refraining from spamming or using bots, and being honest with Starfish and other players.


These are just a few highlights of our expectations. For a comprehensive list of behaviors to avoid, please refer to our Rules of Conduct. We appreciate your cooperation in creating a welcoming and fair gaming environment for everyone.


When accessing or using any Starfish Service, you agree to adhere to certain guidelines and refrain from the following behaviors:


Violation of Laws: You must not violate any applicable law, rule, or regulation.


Interference or Disruption: Do not interfere with or disrupt any Starfish Service, server, or network used to support or provide the service. This includes activities like hacking, cracking, or any actions that compromise the integrity or availability of our Services.


Malicious Software: Do not use software or programs that damage, interfere with, or disrupt Starfish Services or another user's computer or property. This includes actions such as denial of service attacks, spamming, uploading viruses, worms, Trojan horses, spyware, or other harmful software.


Disruptive Behavior: Avoid interfering with another player's use of a Starfish Service. This includes disrupting game play, chat, or dialogue within the service using vulgar or harassing language, engaging in abusive behavior, excessive shouting (using all caps), spamming, flooding, or repeatedly hitting the return key.


Harassment and Bullying: Do not harass, threaten, bully, embarrass, or spam another player, Starfish employee, or representative. Unwanted conduct, including repeated unwanted messages, personal attacks, or statements based on race, sexual orientation, religion, heritage, etc., is strictly prohibited. Hate speech will not be tolerated.


Inappropriate Activities: Refrain from organizing or participating in any activity, group, or guild that is inappropriate, abusive, harassing, profane, threatening, hateful, offensive, vulgar, obscene, sexually explicit, defamatory, infringing, invades privacy, or is otherwise objectionable.


Illegal Content: Do not publish, post, upload, or distribute illegal content or content that you do not have permission to distribute.


Inappropriate Content: Avoid publishing, posting, uploading, or distributing any content (including topics, names, screen names, avatars, etc.) that Starfish, acting reasonably and objectively, deems inappropriate, abusive, hateful, harassing, profane, defamatory, threatening, obscene, sexually explicit, infringing, privacy-invasive, vulgar, offensive, indecent, or unlawful.


Non-Personal Communication: Do not post messages for purposes other than personal communication.


Prohibited messages include advertising, spam, chain letters, pyramid schemes, and other forms of solicitation or commercial activities.


Cheating or Anticompetitive Behavior: Do not engage or assist in cheating or other anticompetitive behavior, such as boosting, collusion, or manipulating matches or matchmaking.


Counterfeit Software or Content: Do not use or distribute counterfeit software or Starfish Content.


Unauthorized Access: Do not attempt to use an Starfish Service through any unauthorized service not controlled or authorized by Starfish. Additionally, do not intentionally obfuscate your network connection, location, or other metadata to gain unauthorized access to an Starfish Service or make purchases.


Unauthorized Account Transfers: Do not sell, buy, share, trade, or transfer your Starfish Account, personal access to Starfish Services, or any associated Starfish Content (including other Entitlements) without express authorization from Starfish. This includes transactions within or outside of Starfish Services.


Export Control Laws: Do not use an Starfish Service in a country where Starfish is prohibited from offering such services under applicable export control laws.


Inappropriate Usernames or Personas: If required to create a username or persona in an Starfish Service, do not use your real name. Additionally, do not use a username or persona that belongs to someone else, is deemed vulgar or offensive by Starfish, or violates another person's rights.


Disturbing Gaming Environment: Refrain from engaging in any activity that significantly disrupts the peaceful, fair, and respectful gaming environment of a Starfish Service.


Misuse of Publicly Available Information: Do not use publicly available information about other users in an Starfish Service (e.g., from leaderboards) for purposes unrelated to the Service, including attempting to identify users in the real world.


Promotion of Prohibited Activities: Do not promote, encourage, or participate in any activities described above that are prohibited within Starfish Services.


To enforce these rules, we may monitor your activity and take action against your Account if you fail to comply. This could include issuing warnings, suspending your Account, permanently banning you, or placing restrictions on your games or related services.


If you or someone using your Account violates these rules and does not rectify the violation after receiving a warning, Starfish reserves the right to take action, such as revoking access to certain or all Starfish Services, Content, or Entitlements, or terminating your Account. In cases of severe violations, Starfish may take immediate action without prior warning. Examples of severe violations include promoting hacking, selling Starfish accounts or entitlements without permission, extreme harassment, or threats of illegal activities. When feasible, Starfish will notify you of the actions taken in response to violations or breaches of this Agreement.


Certain Starfish Services may have additional rules that apply to your conduct while using those services.


If you encounter another user violating these rules, please report the activity to Starfish using the "Help" or "Report Abuse" functions within the relevant Starfish Service, if available. You can also contact Customer Support at [email protected].


Starfish reserves the right to monitor or record online activity and Content on its Services and may remove any Content at its discretion. Please remember that your communications within Starfish Services are public and visible to others.


4.Termination and Other Sanctions


If you violate this agreement or the law, Starfish reserves the right to suspend or terminate your access to our games and services without providing refunds. If Starfish decides to shut down a game or service, we will provide at least 30 days' notice.


This Agreement remains in effect until terminated by you or Starfish. Starfish may terminate your access to any Starfish Services or your Account if it determines that you have violated this Agreement or engaged in unlawful, improper, or fraudulent use of Starfish Services. Whenever possible, Starfish will notify you of the termination. Please note that upon termination, you may lose your username and persona associated with the Account. Depending on the nature of the violation or misuse, Starfish may terminate all of your Accounts and associated Entitlements. If your Account is terminated, you will lose access to your Account and Entitlements and may be prohibited from using any Starfish Service in the future. Termination of your Account also terminates the license granted under this Agreement.


Before terminating your Account, Starfish may issue a warning, suspend or modify your access to specific Starfish Services or your Account, revoke or remove Entitlements at the Account or device level, delete any Content violating this Agreement, or ban your device or machine from accessing certain Starfish Services. If Starfish takes any of these actions, you will not be entitled to a refund (subject to any statutory refund rights), and no Entitlements will be credited or converted into cash or other forms of reimbursement.


5. Use of Data


When you play our games, Starfish collects various information from your computer or device, both online and offline, to operate our business effectively, enhance our products and services, enforce our rules, and communicate with you. This information includes details about your computer or device, hardware, installed software, operating system (such as IP Address and device ID), and your usage patterns within Starfish Services.


If you play our games offline, the data collected will be stored on your device and transmitted to Starfish when your device reconnects to the Internet. Starfish uses this information to operate efficiently, improve our offerings, communicate with you (including for marketing purposes), provide software updates, serve dynamic content, offer software support, enforce our Agreement, and troubleshoot any issues to enhance your overall experience. Additionally, if you engage in online services, Starfish may collect, use, store, transmit, and publicly display statistical data related to your gameplay (such as scores, rankings, and achievements) or identify content that you create and share with other players.


You have the ability to manage certain data collection preferences within the Settings tab of the game client to control how your information is used and shared.


6.Refund Policy.


We will not grant you any refunds, unless otherwise required by law.


7.Intellectual property rights


In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, the Company may, in appropriate circumstances and at its sole discretion, terminate your access to this Site if it considers you to be a repeat infringer. The Company may also, at its sole discretion, limit your access to the Site and/or terminate your membership if you infringe on the intellectual property rights of others, regardless of whether there is any repeat infringement.

8.Changes


We reserve the right to update and modify these Terms of Service periodically. The most current version of these Terms will be posted on our Website and relevant apps. You may be prompted to review and accept the revised Terms to continue using our Services. You also have the option to print and save a copy of these Terms for your records and future reference.


9.Governing Law


These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Nevada, United State.
